Terms of Service

These terms govern use of caprateadvisory.com and any information provided on it. Paid engagements are governed by a separate written engagement letter, which takes precedence over these terms where they differ.
What the service is
Cap Rate Advisory provides flat-fee financial analysis of commercial real estate transactions — deal screening, underwriting, financing options analysis and deal structuring analysis — for clients evaluating acquisitions and capital structures. Analysis is prepared from information supplied by the client and public sources, at the client's stated purchase price and financing assumptions.
What the service is not
- Not real estate brokerage. I do not locate properties, represent buyers or sellers, negotiate transactions, or procure prospects or properties.
- Not mortgage brokerage or loan origination. I do not solicit or negotiate with lenders, arrange or place loans, or receive any compensation from a lender, broker or other party to your transaction.
- Not an appraisal or opinion of value. Deliverables analyze the economics of a transaction at the client's stated price; they do not express an opinion of the market value or estimated price of any property and must not be represented as an appraisal.
- Not investment, securities, legal, tax, accounting, assurance or compilation advice. Nothing on this site or in a deliverable is a recommendation to buy, sell or hold any security or real estate interest, or to invest in any offering.
No guarantee of outcome
Analysis reflects assumptions and information available at the time. I do not guarantee that any transaction will close, that any lender will approve financing, or that projected returns will be achieved. You remain responsible for your own decisions and for obtaining legal, tax and other professional advice.
Fees
Fees are flat, quoted in advance, and payable as set out in the engagement letter (normally 50% at signing and 50% before release of the final deliverable). Fees are not contingent on any transaction outcome.
Confidentiality
Information you provide for an engagement is treated as confidential and used only for that engagement, as set out in the engagement letter.

Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, unless an engagement letter states otherwise.
